Terms of service

Draft v1 — pending counsel review. Governing-law and dispute clauses are placeholders flagged inline. For questions until external review is complete, email jeffreydway@gmail.com.
These terms govern your use of BETR Studios — the Studios workspace for brands and creators, the BEST consumer video app, and any companion clients we publish under the BETR name. By creating an account or otherwise using the service, you agree to these terms.

Acceptance

By creating an account or using BETR Studios, you agree to these terms and to our Privacy Policy. If you don't agree, don't use the service. If you're using BETR on behalf of an organization, you represent that you have authority to bind that organization to these terms.

Account types

  • Brand — corporate / organizational accounts running campaigns, briefs, and creator collaborations. May include multiple team members under a single workspace.
  • Creator — individuals or businesses who publish content, accept brand collaborations, and earn revenue through the platform.
  • Consumer — anyone with an email who uses the BEST consumer surface (watching, liking, commenting, following). Consumers may upgrade to creator at any time.

Your account

You're responsible for safeguarding your credentials and for any activity under your account. You must be at least 13 years old (16 in the EEA) to use the service. Notify us promptly of any unauthorized use.

Acceptable use

You may not:
  • Use the service for illegal purposes or in violation of any applicable law.
  • Impersonate another person, brand, or creator.
  • Upload, publish, or distribute content you don't have the rights to (including third-party music, footage, trademarks, or likeness without clearance).
  • Spam, harass, threaten, or harm other users.
  • Manipulate the platform — fake engagement, vote-rigging, BETR Score manipulation, paid follower schemes.
  • Attempt to access data that doesn't belong to your account or organization.
  • Reverse-engineer, scrape, or abuse the platform APIs we expose.
  • Publish content via Studios that violates the source platform's policies (YouTube, LinkedIn, Instagram, X, TikTok, etc.).
  • Use the service to build a competing product or to train competing ML models.
We may remove content, suspend features, or terminate accounts that violate these rules.

User-generated content

You retain ownership of the content you upload, publish, or generate through Studios — videos, scripts, briefs, comments, profile content. By using the service, you grant BETR a worldwide, non-exclusive, royalty-free license to host, store, process, display, distribute, and create technically necessary derivatives of that content for the sole purpose of operating the service on your behalf (storage, analysis, AI assistance, publishing to the platforms you authorize, displaying on the BEST consumer surface). We claim no ownership of your work.

You are responsible for ensuring you have all necessary rights in any creative material you upload (music licenses, talent releases, brand approvals, etc.). We may remove content reported as infringing under our notice-and-takedown process.

Brand × creator collaborations

BETR Studios is a platform that facilitates collaboration between brands and creators; we are not a party to any contract you form with another user. The rights templates, brief templates, and agreement scaffolds we provide are convenience tools — not legal advice. You're responsible for the terms you agree to. Payments and payouts for collaborations are processed via Stripe (including Stripe Connect for creator payouts); funds may be held in escrow only during the payout flow per Stripe's terms.

BETR Score, AI, and recommendations

BETR Score is a model-based estimate of creator performance — it's not a guarantee of reach, engagement, or revenue. AI-generated briefs, scripts, and creative variations are starting material that require human review; you are responsible for what you publish. The recommendation algorithm honors the preferences you set in /consumer/preferences where technically feasible.

Subscriptions and billing

Paid tiers are billed in advance on a monthly or annual cadence via Stripe. Subscriptions renew automatically until canceled. You may cancel at any time from Settings → Billing; cancellation takes effect at the end of the current billing period and we don't issue refunds for partial periods. Creators may also earn revenue through the platform; payouts follow the schedule and minimums published in /docs/payouts.

Termination

You can delete your account at any time from /legal/account-delete (subject to the 30-day grace period in our Privacy Policy). We may suspend or terminate accounts that violate these terms, that pose a security or legal risk, or that have been inactive for extended periods. Upon termination, your right to use the service ends immediately; provisions intended to survive termination (IP ownership, disclaimers, liability limits, indemnification, governing law) do so.

Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any specific result (revenue, reach, follower growth) will be achieved.

Limitation of liability

To the maximum extent permitted by law, BETR Studios's aggregate liability for any claim arising out of or related to the service is limited to the greater of (a) the amounts you paid us in the 12 months preceding the claim or (b) USD $100. BETR is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.

Indemnification

You agree to indemnify and hold BETR Studios harmless from any third-party claim, loss, or liability arising out of (a) your content, (b) your use of the service, (c) your violation of these terms, or (d) your violation of any third party's rights (including IP, publicity, or platform policies).

Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. [Placeholder pending counsel review — final jurisdiction TBD.]

Dispute resolution

Any dispute arising under these terms will be resolved by binding arbitration administered by a mutually-agreed arbitral body, on an individual basis (no class actions). Either party may seek injunctive relief in court for IP-related claims. [Placeholder pending counsel review — final clause TBD.]

Changes to these terms

We may update these terms; we will notify active users by email at least 30 days before material changes take effect. Continued use after a change takes effect constitutes acceptance.
